Alcopops

Alcopop is a category of alcoholic products that are full of sugar and flavorings and can contain upwards of 10% alcohol in a 24-ounce can (such as Joose, Four Loko, Tilt, Blast) — and can be particularly appealing to youth and young adults.

    Carolina Beach Alcohol Related Laws/Ordinances

    Town of Carolina Beach 0rdinance 28-57

    It shall be unlawful for any person or corporation to take or carry, or cause to be carried, upon the public beaches or quasi-public beaches or water adjacent thereto within the town any glass containers or metal cans that could be used for the purpose of transporting food or beverages or other liquid. This shall not be deemed to include thermos-type bottles, thermos-type containers or baby bottles.

    (a)The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Alcoholic beverage means only a beverage containing at least one-half of one percent alcohol by volume, including malt beverages, unfortified and fortified wine, spirituous liquor, and mixed beverages.

    Fortified wine means any wine made by fermentation from grapes, fruits, berries, rice or honey to which nothing has been added other than pure brandy made from the same type of grape, fruit, berry, rice or honey that is contained in the base wine and which has an alcoholic content of not more than 24 percent alcohol by volume.

    Malt beverage means beer, lager, malt liquor, ale, porter and any other brewed or fermented beverage containing at least one-half of one percent and not more than six percent alcohol by volume.

    Mixed beverage means a drink composed in whole or in part of spirituous liquor and served in quantity less than the quantity contained in a closed package (G.S. 18B-101).

    Public area means public streets, alleys, buildings, grounds or any other area of public ownership.

    Spirituous liquor or liquor means distilled spirits or ethyl alcohol, including spirits of wine, whiskey, rum, brandy, gin and all other distilled spirits and mixtures of cordials, liquor and premixed cocktails in closed containers for beverage use regardless of their dilution.

    Unfortified wine means wine that has an alcoholic content produced only by natural fermentation or by the addition of pure cane, beer or dextrose sugar and that has an alcoholic content of not less than six percent and not more than 17 percent alcohol by volume.

    (b) The consumption of alcoholic beverages, whether in its packaged form or mixed, within any public area shall be prohibited (G.S. 18B-300(c)).

    (1) It shall be unlawful for any person to consume or drink any alcoholic beverages on the public streets in the town by persons who are not occupants of motor vehicles and on property owned, occupied or controlled by the town.

    (2) It shall be unlawful for any person to possess an open container of alcoholic beverages on the public streets in the town by persons who are not occupants of motor vehicles and on property owned, occupied or controlled by the town.

    (3) It shall be unlawful for any person to possess alcoholic beverages on public streets, alleys, or parking lots, which are temporarily closed to regular traffic for special events unless a special use permit is obtained from the Town Manager or his designee a minimum of ten working days prior to the event.

    (4) Notwithstanding the provisions of this section, alcoholic beverages may be served at sidewalk cafes and consumed on commercial pedal vehicles provided the requirements of article VII of chapter 14, commercial pedal vehicles, are met.

    For the purposes of this subsection, the term “open container” means a container whose seal has been broken or a container other than the manufacturer’s unopened original container. As provided by G.S. 18B-102(a), possession or consumption of alcoholic beverages is unlawful except as authorized by the ABC laws.

    (c) Any person violating this section shall be guilty of a misdemeanor punishable by a fine pursuant to the town’s annually adopted rate and fee schedule or imprisonment for not more than 30 days. Each separate offense shall constitute a violation.
